The Risk of Defective Medical Products

The medical device industry is extremely profitable, bringing in roughly $180 billion in revenue in the United States, with a global worth of over $450 billion. Having achieved a steady growth rate of nearly 4% per year, medical device companies are eager to maximize profits. One way they accomplish this is by releasing new and innovative products as quickly as possible, without adequate testing to ensure their safety—which jeopardizes the well-being of consumers and patients. The Journal of the American Medical Association reported that many high-risk medical devices, including life-support devices, are hurried through the approval process with the Food and Drug Administration (FDA). Even worse, the clinical studies used to test these medical devices are inadequate, too brief to uncover side effects or adverse reactions, and lacking in basic scientific standards of rigorous experimentation.

The injuries associated with a defective medical product can be serious, but a compassionate Tacoma attorney could help a plaintiff recover compensation after being hurt by a treatment device.

Case Studies

RoundUp is a very commonly used and famous product to get rid of weeds. The product was created by a company known for formulating agricultural chemicals, Monsanto. Incepted in 1901, the company is now widely criticized for hiding important information which led to a slew of people to be exposed to lymphoma cancer. While most people still agree that the chemical did an amazing job at getting rid of weeds, it isn’t worth risking one’s life. Anyone injured by this dangerous and defective product should work with our skilled lawyers to assemble a case.

It sounds harmless enough. Most of us don’t think twice about talcum powder. We associate its use with babies and cleanliness, and as an everyday household product that eases a rash and feels good on the skin. However, scientific studies dating back to the 1970s have shown that use of talcum powder on female genitals leads to an increased risk of ovarian cancer. Recent legal cases have come to light showing that some talcum powder is contaminated with asbestos. Asbestos is very dangerous and also causes cancer. Fortunately, a product liability lawsuit targeting the negligent manufacturers of talcum powder could help a plaintiff seek the restitution they deserve.

Xarelto, generic name rivaroxaban, is an anticoagulant medication that prevents blood clots by blocking specific blood proteins. Taken orally one to two times per day, this medication is used by patients with atrial fibrillation, an irregular heartbeat, and patients who have recently had hip replacement surgery to prevent both blood clots and strokes. It is also used by patients suffering from pulmonary embolus-PE or deep vein thrombosis-DVT to prevent future blood clots. Xarelto acts as a blood thinner, also known as a direct factor Xa inhibitor, by inhibiting the function of Factor X in the naturally occurring blood coagulation process of the body. Xarelto is often compared with a similar drug known as warfarin, generic name coumadin, which is also a blood thinner—and is said to be as equally effective in preventing non-hemorrhagic strokes in non-valvular atrial fibrillation, or an irregular heartbeat. Xarelto was approved in 2012 by the Federal Drug Administration (FDA) to be used as a blood thinner to prevent strokes. However, in the same year, the FDA ruled against approving Xarelto for blocked coronary arteries.

Risperdal (risperidone) is an atypical antipsychotic medication used to treat schizophrenia, a chronic and serious mental disorder. Schizophrenia often causes psychosis, including hallucinations, delusions, thought disorders (or dysfunctional thinking), and movement disorders. Schizophrenia symptoms also include a flat emotional affect as well as reduced interactions and lowered enjoyment in everyday life. In addition to schizophrenia, Risperdal is also prescribed to treat bipolar disorder (a severe form of depression in which mood swings are rapid and extreme) as well as irritable mood associated with autistic disorder, and ADHD. The positive outcomes achieved by taking Risperdal are increased clarity of thinking and perception, as well as fuller and more productive engagement in everyday life, including work and in close relationships.

Paraquat is an herbicide that has been used by agricultural workers. Paraquat is used to kill weeds. While it is an effective herbicide, Paraquat has also been linked to Parkinson’s disease with people who are exposed to it. Paraquat is currently owned by a Chinese company and it is outlawed in China. It is still legal in the United States, however. If you or a loved one has worked in the agricultural industry and have developed Parkinson’s disease, you may have a solid claim against Paraquat. Our Tacoma defective products representatives could help you file your claim.

Invokana (medical name Canagliflozin) is a drug medication that was developed to treat type 2 diabetes by inhibiting glucose transport proteins, which results in an increased amount of blood glucose elimination through the urine.

Physiomesh, also known as Physiomesh Flexible Composite Mesh, is a flexible, polypropylene large-pore woven mesh that is non-absorbable and made to be compatible with the abdominal tissues. Physiomesh was designed by its manufacturers to replicate the functions of the abdominal wall. Marketed by a subsidiary of Johnson & Johnson known as Ethicon, Physiomesh has been used medically to repair ventral hernia during laparoscopic hernia operations—in which a laparoscope, a lighted scope, is inserted through an incision, enabling repair of the hernia. The Physiomesh is then placed over and into the defect in the abdomen wall to reinforce its stability.

Manufactured by a pharmaceutical company called Janssen Pharmaceuticals, Elmiron is a drug that prescribed to people who have a bladder condition, such as bladder pain and interstitial cystitis. Interstitial cystitis is a condition designed to treat bladder pain or bladder pressure, which often results in people who have bladder urgency and have to use the bathroom a great deal. Studies have shown that Elmiron is toxic to the retina, which is in the eye, and can even cause people to lose their vision. Unfortunately, Elmiron has been prescribed to thousands of people since the mid 1990’s. Studies have also shown that women were the primary demographic who received Elmiron.

Approved by the Food and Drug Administration, FDA, in June of 2012 to help obese people lose weight, the FDA later recalled the drug on February 13, 2020. The FDA recalled the drug because clinical trials produced evidence suggesting there was a link between Belviq and cancer. Based in Japan but with US headquarters in New Jersey, Belviq and Belviq XR are manufactured by a company called Eisai, Inc.

Opioids are a classification of illegal drugs, such as heroin, and legal medications, including oxycodone, codeine, morphine, and hydrocodone. The primary use of opioid medications is as pain relievers. Opioid medications are derived from naturally occurring substances in a plant known as the opium poppy. Opium is extracted from the opium poppy plant by making incisions in the seed capsules after the petals have fallen from the plant. Once incised, a milky latex fluid exudes from the seedpods and coagulates into a gummy brown substance, raw opium. Raw opium is used to manufacturer opioid prescription drug medications, known as opiates. However, scientists have also learned how to make synthetic opioid drugs based on reproducing variations of the chemical structure found in opium.

Taxotere is the brand name for a chemotherapy medication known as Docetaxel (DTX), which is used to counteract cancer, including prostate, head and neck, breast, lung, stomach, and ovarian cancer. Taxotere is sometimes used in combination with other chemotherapy medications. Like most chemotherapy drugs, Taxotere is administered via a slow process of injection into a vein. Multiple studies have found significant increases in mortality—from three months to over five years—following a substantial regimen of at least one week of Taxotere treatment that can be repeated every three weeks. Taxotere treatment for a variety of cancers may eventually lead to remission and recovery from the disease.

You can certainly challenge the taking, but understand this is normally an uphill battle you will likely lose. Since eminent domain is widely accepted, it’s hard to win unless you can show that the government is not taking your property for a legitimate public use. If you refuse, the government will file an action in court and you will have to appear in court, if asked, and file the appropriate legal documents in opposition to those filed by the government. If you lose, and the judge allows the taking to go forward, then a new trial will be started that allows each to make the case for the land’s value.

Every lawyer is different, but The Jackman Law Firm charges a third of whatever money you recover from the government, provided that amount is greater than the original offer you received. We only get paid, in other words, unless you both win and your award is greater than what you would have received without help.

This is a procedure to attempt to settle your case. The special commissioner is made up of three landowners who have no interest or relationship to you or your case. A judge selects them. The commissioners will hear you and your attorney make your case for the value of your land, as well as the government’s side, and from there they will decide the value of your land.

You don’t have to accept the offer from the government. You can fight for more money, but be aware you are going to need certain experts to validate your position, including surveyors, appraisers, and real estate brokers. These experts can persuade the judge or jury the true value of your land.

Every case is unique and different. It can take anywhere from a few months to a few years. In general, cases where the government is involved take a long time, typically a year or so. If a private company is involved, the process will usually be much faster.

You have three years from the date of the accident.

Statistically, it is not likely since most cases settle out of court, but the best way to settle the case is to prepare as though you are going to trial.

It is important to understand whether your doctor can clearly separate which accident caused your injuries. The Jackman Law Firm can assist you in this.
